1. Acceptance of Terms
By accessing or using the Mustgo mobile application, website, or any related services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services. These terms constitute a legally binding agreement between you and Mustgo.
2. Definitions
"Mustgo" refers to the platform and services provided by Mustgo including ride-hailing, food delivery, express delivery, grocery delivery, personal shopping, and handyman services.
"User" refers to any person who accesses or uses the Mustgo platform, including riders, customers, drivers, delivery partners, shoppers, and handyman professionals.
"Service Provider" refers to drivers, delivery partners, personal shoppers, and handyman professionals who provide services through the platform.
"App" refers to the Mustgo mobile application available on Android and iOS.
3. Account Registration
You must create an account to use Mustgo services. You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account. You must be at least 18 years old to create an account.
4. Services
Mustgo provides an online platform connecting users with service providers. We facilitate the transaction but are not a transportation, delivery, or service provider ourselves. The actual services are performed by independent third-party service providers who are not employees or agents of Mustgo.
Ride-Hailing: Mustgo connects passengers with independent drivers for point-to-point transportation.
Food & Grocery Delivery: Mustgo connects users with restaurants, grocery stores, and delivery partners for order fulfilment.
Express Delivery: Mustgo connects senders with delivery partners for parcel transportation.
Handyman Services: Mustgo connects users with independent professionals for home maintenance and repair services.
5. User Obligations
As a user, you agree to:
- Use the platform only for lawful purposes and in compliance with all applicable laws.
- Provide accurate pickup and delivery locations.
- Treat service providers with respect and dignity.
- Not engage in fraudulent, abusive, or harmful behaviour.
- Not use the platform to transport illegal goods or engage in illegal activities.
- Not attempt to manipulate pricing, interfere with the platform's operation, or circumvent fees.
- Not create multiple accounts or use another person's account without authorisation.
6. Service Provider Obligations
If you provide services through Mustgo, you agree to:
- Maintain valid licenses, permits, insurance, and registrations required by law.
- Keep your vehicle or equipment in safe, roadworthy condition.
- Provide professional, courteous service to all users.
- Complete all accepted requests unless legitimate circumstances prevent fulfilment.
- Not discriminate against any user based on race, gender, religion, disability, or any other protected characteristic.
- Comply with all applicable laws including traffic regulations and data protection requirements.
7. Payments and Fees
All charges for services provided through Mustgo are calculated based on applicable rates, including distance, time, service type, and any surge pricing during peak periods. Payment is processed through the platform using your selected payment method. You authorise Mustgo to charge your selected payment method for all fees incurred. All prices are displayed in the local currency (GHS in Ghana) and include applicable taxes unless stated otherwise.
Service providers are paid according to their separate agreements with Mustgo, less applicable commission fees and deductions.
8. Cancellations and Refunds
Cancellation policies vary by service type. Users may cancel a request before a service provider accepts without penalty. After acceptance, cancellation fees may apply. Refunds are evaluated on a case-by-case basis. If you experience an issue with a service, please contact our support team within 48 hours for assistance.
9. Safety and Conduct
Mustgo prioritises the safety of all users. We reserve the right to suspend or terminate accounts for behaviour that compromises safety, including but not limited to: violence, harassment, fraud, driving under the influence, carrying prohibited items, or violating any applicable laws. Users can report safety concerns through the app or by contacting our support team.
In an emergency, please contact local emergency services immediately before contacting Mustgo support.
10. Limitation of Liability
To the maximum extent permitted by law, Mustgo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the platform. Mustgo's total liability for any claim arising from these terms shall not exceed the total fees paid by you in the six months preceding the claim. Mustgo is not liable for the actions or omissions of third-party service providers, including drivers, delivery partners, restaurants, or merchants.
11. Intellectual Property
The Mustgo name, logo, app design, and all related content are the intellectual property of Mustgo. You may not copy, modify, distribute, or create derivative works without our express written consent. You may not reverse engineer, decompile, or disassemble the Mustgo app or attempt to derive its source code.
12. Termination
Mustgo may suspend or terminate your account at any time, with or without cause, including for violation of these terms. Upon termination, your right to use the platform ceases immediately. You may terminate your account at any time by contacting support. Provisions regarding payments, intellectual property, limitation of liability, and dispute resolution shall survive termination.
13. Dispute Resolution
Any disputes arising from these terms shall first be attempted to be resolved through informal negotiation. If unresolved, disputes shall be settled through binding arbitration in accordance with the laws of the Republic of Ghana. The courts of Ghana shall have exclusive jurisdiction over any matters not subject to arbitration.
14. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective upon posting. Your continued use of Mustgo after changes constitutes acceptance of the new terms. For material changes, we will provide notice through the app or via email.
15. Governing Law
These terms shall be governed by and construed in accordance with the laws of the Republic of Ghana, without regard to its conflict of law provisions.
